A friend just called.

He had sent a text message earlier saying he needed some advice for a case. I did not respond immediately to his message as I was apprehending it must be for a false Dowry /Domestic Violence case or someone might have been arrested following a complaint by his wife, and I would listen to the case at the end of day patiently. Given the project that I am working on, these days most of my friends call me for taking suggestions in these cases…..

However, his call has baffled me completely.

He told me his Uncle is in a crisis situation. I asked him – what happened? What he told me has left me confused, angry and with a question mark on human equations (with strangers) in this country. In his own words :

“My Uncle was traveling in the metro enjoying his daily ride. In a jolly good mood, he was humming the song along. To his shock, a lady just poked him and then in quite a derogatory language, asked him to shut his mouth and not sing the song aloud. He was of course taken aback on the way the woman reacted and thus retorted asking her – who was she to suggest him what to do and not do? The lady took an offense and started shouting at him amidst the entire crowd. How dare you talk to me like that? She shouted. He of course knowing fully that he was not at mistake, gave it back, saying she started it first.

The lady perhaps couldn’t gulp the response down…..she started yelling – you were staring at me since very long and were giving passes at me. It was cheap….blah blah blah blah….

Without further a do….police was called by the woman. Both of them were taken to the nearest metro police station. The staff there tried to console the woman as much as possible and also chided the man for shouting at her. But the woman was hell bent on registering the case….why??? She is some commissioner in some department!!! She registered cases of CRIMINAL INTIMIDATION(IPC 506) and Outraging the Modesty of a woman by way of words, gesture or act (IPC 509). My uncle was asked to call two people to sign on a bail bond for him and was released on a surety of Rs.10,000. The entire family is in great stress. No one has ever been implicated in a police case and now the lady just seems to be hell bent on harassing us. We are ready to plead sorry. All the women of the family are crying and clueless as to what will happen next. Please tell me what should we do.” 

Now….let’s not get into the advice I gave my friend. But why this episode has left me speechless?

Let’s understand the two offences under which my friend’s uncle has been booked, from definition of the Penal codes (copied from Indiankanoon website)


Section 506 in The Indian Penal Code, 1860
506. Punishment for criminal intimidation.– Whoever commits the offence of criminal intimidation shall be punished with imprisonment of either description for a term which may extend to two years, or with fine, or with both; If threat be to cause death or grievous hurt, etc. If threat be to cause death or grievous hurt, etc.– and if the threat be to cause death or grievous hurt, or to cause the destruction of any property by fire, or to cause an offence punishable with death or 3[ imprisonment for life], of with imprisonment for a term which may extend to seven years, or to impute unchastity to a woman, shall be punished with imprisonment of either description for a term which may extend to seven years, or with fine, or with both.
Section 509 in The Indian Penal Code, 1860
509. Word, gesture or act intended to insult the modesty of a woman.– Whoever, intending to insult the modesty of any woman, utters any word, makes any sound or gesture, or exhibits any object, intending that such word or sound shall be heard, or that such gesture or object shall be seen, by such woman, or intrudes upon the privacy of such woman, shall be punished with simple imprisonment for a term which may extend to one year, or with fine, or with both.


Both are criminal provisions. Both have severe punishment. Both are extremely difficult for the man to prove that he did not commit the offense. Top it all, the state would be fighting the case against the man in case it goes to the court. Or else, the family would try to settle with whatever price they have to pay. 

I wonder how is a person, without realizing someone is feeling irritated by his gestures, being humiliated in front of so many people, just because he was singing a song supposed to react???? Of course not in a pleasant manner! Moreover….anyone…absolutely anyone on this earth can be in a situation like this. I wonder what if the same was being done by a woman and a man would have requested her to shut up. He would have been in a mess again. 

Is this the WOMEN empowerment we all want in our country now? Is this the empowerment the youth of the country was seeking while protesting at India Gate? Isn’t this gross abuse of the law which is made for the needy? Isn’t this plain massaging of the ego of that woman and she is entitled to do it just because she is a woman????

I feel enraged today. Am I supposed to set every man straight because I have the laws in my favor? Am i free to do anything I want just because I am a woman?

It is one woman who is misusing the powers and there are four other women at the home of this man who are crying buckets because they have never been embroiled in such a thing. What is their right? 

However I somewhere feel happy as well. These kind of instances will only increase as the time goes by. There are 3.2 Crore cases already pending in our courts and cases like these will be generated every day, every second, every hour, adding to the list of Crime Against Women, MAKING A MOCKERY of the word Crime itself.

    Actually there are thousands of MRAs added now every day. If things had to happen this way, I am sure NCW would would need to be dissolved soon.

  3. I know a case, that too happened in Kolkata Metro, and was reported to me yesterday. A lady picks up fight with a man for nothing, blaming him to tease her. Two other woman advocates travelling by same metro was abusing the man as expected..when the train stopped at a station, the warring lady suddenly snatched his purse and ran away…happening too many times nowadays..

    women have excessively emboldened themselves with the disguise of recent safety concerns, many girls audaciously turn violent & slap men even at without or a slightest provocation.
    Men are made fun off if they get beaten by women whereas they considered as evil & villainous if they retaliate to a woman’s slap. so its any way the man’s loss.

    I witnessed an incident when a railway TC asked a young girl for her ticket / pass, but she couldn’t find it Or didn’t have it at all, while she searched it in her purse a Rs. 100 note dropped from it & a guy passing close by, gently tapped her shoulder without being immodest in any way just to asking her to pick her money up, this girl without a single thought turned back & slapped him.

    In another instance a man in his fifties was standing on the platform perhaps waiting for his daughter OR wife, He was quietly standing along the wall at the extreme perimeter of the platform, a young woman from ladies 1st class alighted the running train in hurry & was thrown towards this man with his hands folded, but she suddenly slapped him & accused him of groping her, while the other commuters intervened & even some women passengers joined in his support she escaped the scene, but the elderly man was left weeping, his self esteem must be deeply damaged

    Therefore while laws are framed to protect women from molestation we must have a counter / reverse punishment for those who misuse these laws to arrest / defame someone out of personal vengeance OR sheer audacity thinking “I can get away with it, just because I’m a woman”

    Hell is what this foolish govt is making our nation. No doubt the woman was schizophrenic, but then the uncle must fight back. It’s like teaching such woman a lesson which must be broadcasted at every news channel.

    The word FEMINISM is wrongly represented and wrongly used by the women now a days very much like the word JEHAD wrongly used by Pakistan.

    And yeah Kumar is right, one more MRA added to the list.

    Once my friend had a similar experience. He was traveling in a BMTC sitting in 5th seat from front. A young lady, who looked perfectly healthy boarded the bus and saw all the ladies seats occupied. She approached my friend and rudely said, “Get up, this is ladies seat”. My friend politely refused saying this is not ladies seat. Only first four seats in BMTC are reserved for ladies. She got angry and started a heated argument, Luckily for my friend, the conductor accepted that it was not ladies seat and instructed her to stand.

    In another incident that happened to my friend in Majestic Bus Stand in Bangalore was simply outrageous. He is a law student and was going with another male friend. It was crowded and a lady approached his male friend and suddenly slapped him. She started to create a drama that he assaulted her. Then a crowd gathered with some heated arguments. Two police constables caught attention of the crowd gather and they took the lady and my friends to police station. In police station, on hearing the lady’s complaint, the inspector slapped my friends’ friend. My friend being a law student knew few famous lawyers. He called them up and a case was filed and they were sent back. After getting out of police station for a few distance, that lady approached my friends. She demanded Rs.10,000 on spot and promised to drop the case.

    Women try to misuse our loosely defined laws and men are victimized in many instances. There is a need for counter law to punish them.

    Deepika maam, if a man and woman end up in a verbal altercation and the man ends up using swear words(which are very commonly used), how many days will he end up in jail??
